The problem you both have is whatever video you claim is going to actually evidence ‘attempted murder’ clearly faces some obstacles.

The FBI is certainly not going to publicize any video it claims ‘exonerates’ the ICE fatal shooting. That puts a painted target out there for about 200 million people other than you that will be used to haunt Noem, Patel and Bondi at every interview for the rest of their days. Also, Feds have no way of establishing chain of control on private citizen videos. It is highly unlikely to be admissible to them. No, the exoneration will come from FBI/DOJ in about a 5 sentence release…..you can take your personal comfort in that …at least until the supremacy clause pre-emption period tolls at the point of that exoneration.

Secondly, do you think you will ever get the satisfaction of any actual DOJ person using the words ‘attempted murder”? Nothing Minnesota and probably 70% of the country would love more than Feds bringing post-humous charges and getting a court case opened up.

I think it is beyond ironic that Trump was threatening Iran if they killed their protestors, with intervention. Let's face it .. Trump & his self-righteous followers are our version of the 'ayatollah" and the 'revolutionary guard" . It is shameful that we (USA) once viewed as a beacon of democracy, justice have fallen so far.

Can the Minnesota police conduct their own investigation since their citizen was killed? In Florida and perhaps elsewhere, I’m afraid the color of the victim would determine who the guilty party was.

According to the statement from the BCA, unless they have access to the evidence that the FBI is holding, they can't make a prosecutable case. That said, I have the same question given all the video footage out there, eye witness accounts, etc. I wouldn't be surprised if there aren't indictment forthcoming, that they might step back in.

Again, the New York Times piblished a report rebuking the alligation that this scum was in danger. The only murder here is another member of law enforcement in the US killing someone. How many times will these "agents" break their own "rules" and "policies"? How many people is it okay yo have killed? How many preists is it okay to beatup? How many memorials is it okay to kick over? How many school children need to be pepper sprayed? How many high schools need to be raided? How many neighborhoods need to be tear gassed? How many communters stuck in traffic need to be tear gassed? How many American Citizens need to be arrested and denied due process? How many more random South American fishermen need to be blown up? How many more American soldiers need to die overseas fighting for greed? Is there ever enough for people like you? Becauee it never ends. Check your history books.

Touhy v. Ragen will definitely slow any state action down, but I think they ought to file the complaint anyway just using the videos and eyewitness accounts in hand. After all, does anybody really think the Feds will do anything to collect evidence beyond what is already out there? Do any supporters of ICE shooting Mrs. good actually think there is any eyewitness on that street in Minnesota other than other ICE that is going to say the officer ‘was being run down?’ That will create some court time pressure on the Feds to either file or drop. Once the Feds drop the supremacy clause becomes moot. Obviously, even then Feds will certainly drag their heels (which they have practiced so well on Epstein) already.

The other step needed is to file a civil case. The courts are often more lenient in allowing civil subpoenas to go into effect (Touhy does not apply). Also, nothing stops the FOIA experts from getting going and getting their requests in. It is sometimes surprising what comes out just through the FOIA channel.

In any event, we will not forget.
